Documents in Full Force and Effect. All Financing Documents shall remain in full force and effect and not be terminated. The Lender may, without waiving this condition, consider it fulfilled, and a representation and warranty by the Borrower to the Lender to such effect made, if no written notice to the contrary is received from the Borrower prior to the making of the applicable Loan.
