During Construction Repair Work. The Proponent shall be entitled to conduct During Construction Repair Work provided that: (a) except in cases of Emergency, the Proponent gives at least five (5) business days' prior written notice to the County that During Construction Repair Work will occur if such Repair Work: (i) will have or is likely to have Traffic Effects; or (ii) could present a danger to public health and safety. (b) The written notice of pending during construction repair work shall identify the location(s), scope and methods of the repair work, Within five (5) business days of the County's receipt of the above written notice the County shall review the location(s), scope and methods and shall approve of the proposed repair work or require modifications to the location(s), and/or the scope and/or the methods at its reasonable discretion; (c) all During Construction Repair Work is carried out in accordance with the latest version of the applicable Ontario Provincial Standard Specifications (OPSS's) and the Ontario Provincial Standard Drawings (OPSD's); (d) all Repair Work complies with the requirements of Sections 4 of this agreement; (e) all repair work carried out shall be subject to inspection and acceptance by the County and/or its agent(s).
