DUTIES ARISING FROM LICENSEE’S SPECIAL. POSITION Obligations regarding no abuse of the DCC's special position 4.1 The Contractor shall at all times manage and perform the Services in a way that is calculated to ensure that it does not restrict, prevent, or distort competition: 4.1.1 in any activity (other than the Authorised Activity) that is authorised by an Energy Licence under the Principal Energy Legislation; or 4.1.2 in the provision of, or in any of the markets for, Commercial Activities that are connected with the Supply of Energy under the Principal Energy Legislation. 4.2 In performing any of the Services, the Contractor shall not unduly discriminate between any person or any class or description of persons in connection with the provision of the Services. 4.3 The Contractor shall establish and maintain management systems, procedures and arrangements that are designed to secure its compliance with its obligations under Clauses 4.1 to 4.3.
