The Dynamic Purchasing System Period clause defines the timeframe during which a dynamic purchasing system (DPS) is active and available for use by buyers and suppliers. This period typically starts from the official launch date of the DPS and continues until a specified end date or until the system is terminated according to the agreement's terms. For example, suppliers may only apply to join or submit bids while the DPS is open, and contracts awarded under the DPS must be completed within this period. The core function of this clause is to establish clear temporal boundaries for participation and procurement activities, ensuring all parties understand when the system is operational and when it concludes.
DYNAMIC PURCHASING SYSTEM PERIOD. 10.1 This Dynamic Purchasing System Agreement shall take effect on the DPS Commencement Date and shall expire, unless it is terminated earlier in accordance with the terms of this Dynamic Purchasing System Agreement or otherwise by operation of Law, either
10.1.1 at the end of the Initial Dynamic Purchasing System Period; or
10.1.2 where the Authority elects to extend the Initial Dynamic Purchasing System Period in accordance with Clause 10.2 below, at the end of the Extension Dynamic Purchasing System Period.
10.2 The Authority may extend the duration of this Dynamic Purchasing System Agreement for any period or periods up to a maximum of one (1) year in total from the expiry of the Initial Dynamic Purchasing System Period by giving the Supplier no less than three (3) Months' written notice.
C. DYNAMIC PURCHASING SYSTEM AGREEMENT PERFORMANCE
DYNAMIC PURCHASING SYSTEM PERIOD. 10.1 This Dynamic Purchasing System Agreement shall take effect on the DPS Commencement Date and shall expire, unless it is terminated earlier in accordance with the terms of this Dynamic Purchasing System Agreement or otherwise by the operation of Law, either;
10.1.1 at the end of the Initial DPS Period; or
10.1.2 where the Authority elects to extend the Initial DPS Period in accordance with Clause 10.1.2 below;
10.2 The Authority may extend the duration of this Dynamic Purchasing System Agreement for any period or periods up to a maximum of 1 year (12 months) in total from the expiry of the Initial Dynamic Purchasing System Period by giving the Supplier no less than three (3) Months' written notice.
10.3 The Authority acknowledges that the DPS will not be terminated within the initial first six (6) months from the DPS commencement date.
