Common use of Early Termination or End of Term without Extension Clause in Contracts

Early Termination or End of Term without Extension. Upon early termination or default by Utility, or expiration of the term without notice of extension by Utility, ownership of Energy and Environmental Attributes shall revert to Owner, and where feasible and at Owner's election, (i) Owner will have the option to operate the system as a net- metered system, subject to the interconnection and parallel generation standards in place at that time, or (ii) Utility will continue to purchase power upon separate agreement with Owner on terms and conditions acceptable to the Parties, including but not limited to setting a new power purchase rate.
