Common use of Easement Duration Clause in Contracts

Easement Duration. Where permitted by State law, FRPP conservation easements must be perpetual. Where State law prohibits perpetual conservation easements, FRPP conservation easements must be for a term of no less than 30 years. Some States allow landowners the right to revisit and terminate their conservation easements after a certain time period that may be less than 30 years. Conservation easements that contain such language may only be funded if such termination rights are mandated by State law.
