Easement Reservation Clause Samples

An Easement Reservation clause establishes the right of a property owner to retain certain usage rights over a portion of the property being transferred or sold. Typically, this clause allows the seller to continue using part of the land for specific purposes, such as access, utilities, or maintenance, even after ownership has changed. By clearly defining these retained rights, the clause ensures that both parties understand the ongoing obligations and privileges, thereby preventing future disputes and facilitating smooth property transactions.

Easement Reservation. The Landlord, for itself, its agents or assigns, reserves a perpetual access easement over and across the West 40 feet of the Premises and the South 40 feet of the Premises, for purposes of accessing adjoining property that is owned by the Landlord or its affiliates. The Tenant shall have the right to move the location of the easement, so long as it does not unreasonably interfere with the ability of the Landlord to access such adjoining property.
