Common use of Easements and Rights-of-Way Clause in Contracts

Easements and Rights-of-Way. To the extent practicable, the Developer shall locate the Extended Facilities within Plan property to be dedicated for use as streets or other public rights-of-way. The Developer shall convey to the Authority, prior to and as a condition to the Authority’s acceptance of the Extended Facilities, an easement and right-of-way giving the Authority the right to construct, operate, maintain, repair, remove, rebuild and abandon in the place the .
