Education Act 2002. 2.3.1. Section 175 of this Act places a duty on both the Education Provider and the LA to safeguard and promote the welfare of children. The LA’s ability to fulfil this role is dependent on ongoing receipt of core pupil data from Education Providers to ensure properly informed decisions are reached. Without this the LA would have to make decisions and allocate resources based on an incomplete pupil dataset. This would lead to inefficiencies and pose an obvious increased risk to vulnerable children and young people.

Education Act 2002. Section 175 - A local education authority shall make arrangements for ensuring that the functions conferred on them in their capacity as a local education authority are exercised with a view to safeguarding and promoting the welfare of children.
Education Act 2002. The Section 11 duty of the Children Act 2004 complements the duty placed by Section 175 of the Education Act 2002 on Local Education Authorities and the governing bodies of both maintained schools and further education institutions to make arrangements to carry out their functions with a view to safeguarding and promoting the welfare of children and follow the guidance in ‘Safeguarding Children in Education (DFES 2004). Proprietors of Independent Schools also have a duty to safeguard and promote the welfare of pupils at the school under Section 157 of the Education Act 2002 and the Education (Independent Schools Standards) Regulations 2003.
