Common use of Effect of a Breach Clause in Contracts

Effect of a Breach. In the event that you have been found to have materially breached this Agreement (including the Restrictive Covenant Agreement, as modified herein), in addition to any other legal or equitable remedies it may have for such breach, the Company shall have the right to terminate your at will employment (if you are still employed) and you will not be entitled to any of the payments, benefits and opportunities under this Agreement except those for which you have already qualified. Any such consequences of a breach by you will not affect the release or your continuing obligations under this Agreement.

In the event that you have been found fail to have materially breached comply with any of your obligations under this Agreement (including the Restrictive Covenant Noncompetition Agreement, as modified herein), in addition to any other legal or equitable remedies it may have for such breach, the Company shall have the right to terminate your at will employment (if you are still employed) and you will not be entitled to any of the payments, benefits and opportunities under this Agreement except those for which you have already qualifiedexclusive of salary through the Separation Date. Any such consequences of a breach by you will not affect the release or your continuing obligations under this Agreement.

Any such consequences actions in the event of a breach by you will not affect the release or your continuing obligations under this Agreement.

Any such consequences actions in the event of a breach by you will not affect the release or your continuing obligations under this Agreement.
