Common use of Effect of Amendment or Waiver Clause in Contracts

Effect of Amendment or Waiver. The Investors and Founders and ----------------------------- their respective successors and assigns acknowledge that by the operation of Section 5.7 hereof the holders of a majority of the outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares acting in conjunction with the Company, will have the right and power to diminish or eliminate all rights pursuant to this Agreement.

Effect of Amendment or Waiver. The Investors and Founders and ----------------------------- their respective successors and assigns acknowledge that by the operation of Section 5.7 5.10 hereof the holders of a majority Investors holding more than sixty percent (60%) of the outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares Securities, acting in conjunction with the Company, will have the right and power to diminish or eliminate any or all rights pursuant to this Agreement.

Effect of Amendment or Waiver. The Investors and Founders and ----------------------------- their respective successors and assigns acknowledge that by the operation of Section 5.7 3.7 hereof the holders of a majority fifty percent (50%) of the outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares Securities, acting in conjunction with the Company, will have the right and power to diminish or eliminate any or all rights or increase any or all obligations pursuant to this Agreement.

Effect of Amendment or Waiver. The Investors and Founders their successors and ----------------------------- their respective successors and assigns acknowledge that by the operation of Section 5.7 hereof 4.7 of this Agreement the holders of a majority of the outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares Securities, acting in conjunction with the Company, will have the right and power to diminish or eliminate any or all rights or increase any or all obligations pursuant to this Agreement.

Effect of Amendment or Waiver. The Investors Each Investor and Founders and ----------------------------- their each such Investor’s respective successors and assigns acknowledge that by the operation of of, and subject to, Section 5.7 hereof hereof, the holders of a majority at least seventy-five percent (75%) of the then outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares Securities, acting in conjunction with the Company, will have the right and power to diminish or eliminate all rights pursuant to this Agreement.

Effect of Amendment or Waiver. The Investors Holders and Founders their successors and ----------------------------- their respective successors and assigns acknowledge that by the operation of Section 5.7 hereof 3.8 of this Agreement the holders of a majority 66 2/3% of the outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares Xxxxxx Xxxxxxx, acting in conjunction with the Company, will have the right and power to diminish or eliminate any or all rights or increase any or all obligations pursuant to this Agreement.

The Investors and Founders and ----------------------------- their respective successors and assigns acknowledge that by the operation of Section 5.7 hereof (but subject to the holders limitations therein) the Holders of a majority the requisite percentage of the outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares Securities, acting in conjunction with the Company, will have the right and power to diminish or eliminate any or all rights pursuant to this Agreement.

The Investors and Founders and their successors ----------------------------- their respective successors and assigns acknowledge that by the operation of Section 5.7 3.7 hereof the holders of a majority fifty-five percent (55%) of the outstanding Registrable Securities and the holders of a majority of the oustanding Series C shares Securities, acting in conjunction with the Company, will have the right and power to diminish or eliminate any or all rights or increase any or all obligations pursuant to this Agreement.
