Common use of Effect of an Event of Default and Remedies of Landlord Clause in Contracts

Effect of an Event of Default and Remedies of Landlord. Upon the occurrence of any Event of Default, as a result thereof and without other action by Landlord, Landlord shall have the option to (i) declare the rights of Tenant under this Lease terminated, and thereafter recover possession of the Premises through legal process, (ii) proceed for past due installments of the Rent and other sums due, reserving its rights to proceed later for the remaining installments, or (iii) pursue any other remedies available at law or in equity to Landlord on account of the Event of Default. Landlord agrees to use reasonable efforts to mitigate damages on account of any default by Tenant. All of the remedies hereinbefore given to Landlord and all rights and remedies given to it by law and equity shall be cumulative and concurrent. The taking or recovering of the Premises shall not deprive Landlord of any of its remedies or actions against Tenant for rent or any and all other sums due, nor shall the bringing of any action for rent or for breach or default under any term, condition or covenant, or the resort to any other remedy herein provided for the recovery of rent, be construed as a waiver of the right to obtain possession of the Premises.
