Effect of Breach of Essential Term. (a) The parties agree that the consent of the framework parties in clause 3.1 of the framework ILUA, their agreement in clause 3.2 of the framework ILUA and the accepted exploration contract do not apply in the circumstances set out in clause 15 (and, accordingly, subject to clause 3.6(b), the right to negotiate procedure will apply to an excluded tenement). (b) However, neither the state nor SACOME acknowledges that the right to negotiate procedure applies to any miscellaneous purposes licence which is an excluded tenement.
