Common use of Effect of Confirmation Clause in Contracts

Effect of Confirmation. The Confirmation relating to a Transaction, together with this Agreement, are prima facie evidence of the terms agreed between the parties for that Transaction, unless objection is made with respect to the Confirmation promptly after it is received. If there is any conflict between the terms of a Confirmation and this Agreement, the Confirmation prevails in respect of that Transaction and those terms only.
