Effect of Expansion. Effective as of the Expansion Effective Date (defined in Section 1.2 below), the Premises shall be increased from 18,921 rentable square feet on the 1st floor to 25,003 rentable square feet on the 1st, 2nd and 3rd floors by the addition of the Expansion Space, and, from and after the Expansion Effective Date, the Existing Premises and the Expansion Space shall collectively be deemed the Premises. The term of the Lease for the Expansion Space (the “Expansion Term”) shall commence on the Expansion Effective Date and, unless sooner terminated in accordance with the Lease, end on the last day of the term of the Lease for the Existing Premises (which the parties acknowledge is November 30, 2015). From and after the Expansion Effective Date, the Expansion Space shall be subject to all the terms and conditions of the Lease except as provided herein. Except as may be expressly provided herein, (a) Tenant shall not be entitled to receive, with respect to the Expansion Space, any allowance, free rent or other financial concession granted with respect to the Existing Premises, and (b) no representation or warranty made by Landlord with respect to the Existing Premises shall apply to the Expansion Space.
Effect of Expansion. Effective as of, and from and after, the Expansion Effective Date (defined in Section 1.2 below) for any Expansion Space, (a) the Premises shall be increased by the addition of such Expansion Space, and (b) such Expansion Space shall be included in the Premises subject to all the terms and conditions of the Lease except as provided herein. With respect to each Expansion Space, the term of the Lease (the “Expansion Term”) shall begin on the applicable Expansion Effective Date and, unless sooner terminated in accordance with the Lease, end on the Second Extended Expiration Date (defined in Section 1.4 below). Except as may be expressly provided herein, (a) Tenant shall not be entitled to receive, with respect to any Expansion Space, any allowance, free rent or other financial concession granted with respect to the Existing Premises, and (b) the representation or warranty set forth in the last sentence of Section 25.5 of the Lease shall not apply to any Expansion Space.
Effect of Expansion. Effective as of, and from and after the Expansion Effective Date (defined in Section 1.2 below), (a) the Premises shall be increased from 9,716 rentable square feet on the 2nd floor of the Building to 28,121 rentable square feet on the 2nd and 3rd floors of the Building by the addition of the Expansion Space, and (b) the Expansion Space shall be included in the Premises subject to all the terms and conditions of the Lease except as provided herein. The term of the Lease with respect to the Expansion Space (the “Expansion Term”) shall begin on the Expansion Effective Date and, unless sooner terminated in accordance with the Lease, end on the Modified Expiration Date (defined in Section 1.4 below). Except as may be expressly provided herein, Tenant shall not be entitled to receive, with respect to the Expansion Space, any allowance, free rent or other financial concession granted with respect to the Existing Premises.
Effect of Expansion. Effective as of the Expansion Effective Date (defined in Section 1.2 below), the Premises shall be increased from 13,254 rentable square feet on the second floor to 16,356 rentable square feet on the second floor by the addition of the Expansion Space, and, from and after the Expansion Effective Date, the Existing Premises and the Expansion Space shall collectively be deemed the Premises. The term of the Lease for the Expansion Space (the “Expansion Term”) shall commence on the Expansion Effective Date and, unless sooner terminated in accordance with the Lease, end on the last day of the term of the Lease for the Existing Premises (which the parties acknowledge is January 31, 2013). From and after the Expansion Effective Date, the Expansion Space shall be subject to all the terms and conditions of the Lease except as provided herein, and except that, except as may be expressly provided in this Amendment, Tenant shall not be entitled to receive, with respect to the Expansion Space, any allowance, free rent or other financial concession granted with respect to the Existing Premises.
Effect of Expansion. In the event of any expansion of the Subleased Premises pursuant to this Section 5.2 (whether triggered by Sublandlord’s Occupancy Notice or Subtenant’s Expansion Notice), the applicable Quadrant(s) will be added to become a part of the Subleased Premises on the same terms and conditions (i.e., same Base Rent rate per square foot, etc.) as the initial Subleased Premises.
Effect of Expansion. Effective as of the Expansion Space Commencement Date (defined in Paragraph 3.2 below), the Premises shall be increased by the addition of the Expansion Space, and, from and after the Expansion Space Commencement Date, the Expansion Space shall be deemed a portion of the Premises. The term of the Lease for the Expansion Space (the “Expansion Space Term”) shall commence on the Expansion Space Commencement Date and, unless sooner terminated in accordance with the Lease, end on the First Extended Expiration Date. From and after the Expansion Space Commencement Date, the Expansion Space shall be subject to all the terms and conditions of the Lease except as provided herein. Except as may be expressly provided herein, Landlord makes no representation or warranty with respect to the existing Suite 150 Space or the Expansion Space, and the Expansion Space is being delivered to Tenant in its “AS-IS” condition. Notwithstanding the foregoing, Landlord shall deliver the Expansion Space to Tenant in good working order and repair on the date possession of the Expansion Space is delivered to Tenant, including, without limitation, the roof, HVAC, electrical, plumbing and lighting systems serving the Expansion Space and in the event of any defects therein, Landlord, at its sole cost, shall repair each such defect promptly after being informed thereof in writing and in reasonable detail by Tenant so long as Tenant provides Landlord with written notice of any defect within ninety (90) days of the Expansion Space Commencement Date.
Effect of Expansion. Effective as of the Expansion Effective Date (defined in Section 1.2 below), the Premises shall be increased by 4,676 rentable square feet on the fourth floor by the addition of the Expansion Space, and, from and after the Expansion Effective Date, the Existing Premises and the Expansion Space shall collectively be deemed the Premises. The term of the Lease for the Expansion Space (the “Expansion Term”) shall commence on the Expansion Effective Date and. unless sooner terminated in accordance with the Lease, end on the Expiration Date (which the parties acknowledge is March 31, 2015). From and after the Expansion Effective Date, the Expansion Space shall be subject to all the terms and conditions of the Lease except as provided herein. Except as may be expressly provided herein, (a) Tenant shall not be entitled to receive, with respect to the Expansion Space, any allowance, free rent or other financial concession granted with respect to the Existing Premises, and (b) no representation or warranty made by Landlord with respect to the Existing Premises shall apply to the Expansion Space.
Effect of Expansion. Effective as of the Expansion Effective Date, the Premises shall be increased from 8,138 RSF on the eighteenth (18th) floor to 20,025 RSF on the eighteenth ( 18 1h) (8,138 RSF) and twenty-third (23rd) (I 1 887 RSF) floors by the addition of the Expansion Space, and, from and after the Expansion Effective Date, the Existing Premises and the Expansion Space shall collectively be deemed the Premises; however, from and after the Extension Date, as a consequence of the remeasurement of the Existing Premises described in Section 1 above, the Premises shall be deemed further increased from 20,125 RSF to 20,208 RSF (i.e., 8,321 RSF on the eighteenth (18th) floor and 11,887 RSF on the twenty third (23rd) floor of the Building), assuming the Expansion Effective Date has occurred. The term of the Lease for the Expansion Space (the “Expansion Term”) shall commence on the Expansion Effective Date and, unless sooner terminated in accordance with the Lease, end on the Extended Expiration Date. From and after the Expansion Effective Date, the Expansion Space shall be subject to all the terms and conditions of the Lease except as provided herein. Except as may be expressly provided herein, (a) Tenant shall not be entitled to receive, with respect to the Expansion Space, any allowance, free rent or other financial concession granted with respect to the Existing Premises, and (b) no representation or warranty made by Landlord with respect to the Existing Premises shall apply to the Expansion Space.
Effect of Expansion. Effective as of the Expansion Effective Date, the Premises shall be increased from 23,614 rentable square feet on the 7th floor to 47,228 rentable square feet on the 7th and 8th floors by the addition of the Expansion Space, and, from and after the Expansion Effective Date, the Existing Premises and the Expansion Space shall collectively be deemed the Premises. The term of the Lease for the Expansion Space (the “Expansion Term”) shall commence on the Expansion Effective Date and, unless sooner terminated .in accordance with the Lease, end on the Extended Expiration Date. From and after the Expansion Effective Date, the Expansion Space shall be subject to all the terms and conditions of the Lease, including Landlord’s obligations under Section 5.2 of the Lease, except as provided herein. For the avoidance of doubt, neither Section 1.4 of the Lease nor Exhibit B to the Lease shall apply to the Expansion Space.
Effect of Expansion. Effective as of the Temporary Suite 310 Expansion Effective Date (defined in Section A below), the Premises shall be increased from 81,560 rentable square feet on the first, second, fourth and fifth floors to 85,674 rentable square feet on the first, second, third, fourth and fifth floors by the addition of the Temporary Suite 310 Expansion Space, and, from and after the Temporary Suite 310 Expansion Effective Date through the Temporary Suite 310 Expansion Expiration Date (defined in Section A below), the Existing Premises and the Temporary Suite 310 Expansion Space shall collectively be deemed the Premises. The term of the Lease for the Temporary Suite 310 Expansion Space (the “Temporary Suite 310 Expansion Term”) shall commence on the Temporary Suite 310 Expansion Effective Date and, unless sooner terminated in accordance with the Lease, end on the Temporary Suite 310 Expansion Expiration Date. During the Temporary Suite 310 Expansion Term, the Temporary Suite 310 Expansion Space shall be subject to all the terms and conditions of the Lease except as provided herein. Except as may be expressly provided herein, (a) Tenant shall not be entitled to receive, with respect to the Temporary Suite 310 Expansion Space, any allowance, free rent or other financial concession granted with respect to the Existing Premises, and (b) no representation or warranty made by Landlord with respect to the Existing Premises shall apply to the Temporary Suite 310 Expansion Space.
