Common use of Effective Date; Term of the Insurance Agreement Clause in Contracts

Effective Date; Term of the Insurance Agreement. This Insurance Agreement shall take effect on the Date of Issuance and shall remain in effect until the later of (a) such time as the Insurer is no longer subject to a claim under the Policy and the Policy shall have been surrendered to the Insurer for cancellation and (b) all amounts payable to the Insurer by the Servicer, the Indenture Trustee, the Back-up Servicer, the Seller or the Depositor or from any other source under the Transaction Documents and all amounts payable under the Obligations have been paid in full; provided, however, that the provisions of Sections 3.02, 3.03, 3.04 and 4.06 hereof shall survive any termination of this Insurance Agreement.

This Insurance Agreement shall take effect on the Closing Date of Issuance and shall remain in effect until the later of (a) such time as the Note Insurer is no longer subject to a claim under the Policy and the Policy shall have been surrendered to the Note Insurer for cancellation and (b) all amounts payable to the Note Insurer by the Sponsor, the Originator, the Servicer, the Indenture Trustee, the Back-up Servicer, Company and the Seller or the Depositor hereunder or from any other source hereunder or under the Transaction Company Documents and all amounts payable under the Obligations Notes have been paid in full; provided, however, that the provisions of Sections 3.02, 3.03, 3.04 3.04, 3.05 and 4.06 3.06 hereof shall survive any termination of this Insurance Agreement.
