Common use of Effective on receipt Clause in Contracts

Effective on receipt. A Notice given in accordance with clause 12.1 takes effect when received (or at a later time specified in it), and is taken to be received: (a) if hand delivered or left at the recipient’s address, on delivery; (b) if sent by prepaid post, the third Business Day after the date of posting, or the seventh Business Day after the date of posting if posted to or from outside Australia; and (c) if sent by facsimile, when the sender’s facsimile system generates a message confirming successful transmission of the entire Notice unless, within one Business Day after the transmission, the recipient informs the sender that it has not received the entire Notice, but if the delivery or transmission under paragraph (a) or (c) is outside Business Hours, the Notice is taken to be received at the commencement of Business Hours after that delivery, receipt or transmission.

Effective on receipt. A Notice given in accordance with clause 12.1 40.1 takes effect when it is taken to be received (or at a later time specified in it), and is taken to be received: (a) if hand delivered or left at the recipient’s addressdelivered, on delivery; (b) if sent by prepaid post, on the third second Business Day after the date of posting, posting (or on the seventh Business Day after the date of posting if posted to or from a place outside Australia); andor (c) if sent by facsimile, when the sender’s 's facsimile system generates a message confirming successful transmission of the entire Notice unless, within one Business Day after the transmission, the recipient informs the sender that it has not received the entire Notice, but if the delivery delivery, receipt or transmission under paragraph (a) is not on a Business Day or (c) is outside after 5.00pm on a Business HoursDay in the place where the Notice is taken to be received, the Notice is taken to be received at 9.00am on the commencement of next Business Hours after that delivery, receipt or transmissionDay in the place where the Notice is taken to be received.

Effective on receipt. A Subject to paragraph (c), a Notice given in accordance with this clause 12.1 takes effect when taken to be received (or at a later time specified in it), and is taken deemed to be received: : (ai) if hand delivered or left at the recipient’s addressdelivered, on delivery; ; (bii) if sent by prepaid post, the third three clear Business Day Days after the date of posting, posting (or the seventh seven clear Business Day Days after the date of posting if posted to or from a place outside Australia); and (ciii) if sent by facsimile, when the sender’s facsimile system generates a message confirming successful transmission of the entire Notice unless, within one eight Business Day Hours after the transmission, the recipient informs the sender that it has not received the entire Notice, but ; (iv) if sent by email then when it enters the recipient’s mail delivery or transmission under paragraph (a) or (c) is outside Business Hours, the Notice is taken to be received at the commencement of Business Hours after that delivery, receipt or transmissionsystem.

A Notice given in accordance with clause 12.1 9.1 takes effect when taken to be received (or at a later time specified in it), and is taken to be received: (a) if hand delivered or left at the recipient’s addressdelivered, on delivery; (b) if sent by prepaid post, on the third second Business Day after the date of posting, posting (or on the seventh Business Day after the date of posting if posted to or from a place outside Australia; and); (c) if sent by facsimile, when the sender’s 's facsimile system generates a message confirming successful transmission of the entire Notice unless, within one eight Business Day Hours after the transmission, the recipient Recipient informs the sender that it has not received the entire Notice, but if the delivery delivery, receipt or transmission under paragraph (a) is not on a Business Day or (c) is outside after 5.00pm on a Business HoursDay, the Notice is taken to be received at 9.00am on the commencement of next Business Hours after that delivery, receipt or transmissionDay.
