Common use of Effectiveness; Survival Clause in Contracts

Effectiveness; Survival. This Agreement shall become effective on the date on which all parties hereto shall have signed a counterpart copy hereof and shall have delivered the same to the Lender. All representations and warranties made herein and in the other Loan Documents and in the certificates delivered pursuant hereto or thereto shall survive the making by the Lender of the Loans, in each case, as herein contemplated and the execution and delivery to the Lender of the Notes evidencing the Loans and shall continue in full force and effect so long as the Obligations hereunder are outstanding and unpaid and the Commitments are in effect. The obligations of the Company pursuant to Section 3.07, Section 3.08, Section 3.10 and Section 9.03 shall survive termination of this Agreement and payment of the Obligations.

The obligations of the Company pursuant to Section 3.07, Section 3.08, Section 3.10 3.09, Section 6.15 and Section 9.03 shall hereof shall, notwithstanding anything herein to the contrary, survive termination of this Agreement and payment of the Obligations.

The obligations of the Company pursuant to Section 3.07, Section 3.08, Section 3.10 and Section 9.03 shall survive termination of this Agreement and payment of the Obligations.

The obligations of the Company pursuant to Section 3.073.05, Section 3.08, Section 3.10 3.06 and Section 9.03 13.03 shall survive termination of this Agreement and payment of the Obligations.
