Common use of Efforts to Obtain Sublicense Rights Clause in Contracts

Efforts to Obtain Sublicense Rights. If RPRP or Introgen undertakes to acquire from a third party a technology or patent rights that are intended for use or application with respect to a Collaboration Product, RPRP and Introgen (as the case may be) shall use good faith efforts to acquire from such third party the right to sublicense or otherwise make available to the other party hereto, such technology or patent rights to the extent the same are to be used in or applied to Collaboration Products. It is understood, however, that neither party will be obligated to incur additional costs or hardship in connection with such efforts to acquire such sublicensing or other rights in accordance with this Section 9.4.
