Common use of EFP Clause in Contracts

EFP. If a Transaction is part of an EFP transaction conducted in accordance with the rules of the New York Mercantile Exchange (“NYMEX”), Buyer shall sell and Seller shall buy a number of futures contracts for the specified Product and month provided in the terms of the Transaction equal to the volume to be delivered pursuant to the Transaction on a date to be mutually agreed by Buyer and Seller.

EFP. If a Transaction this Agreement is part of an EFP transaction (an “EFP Transaction”) conducted in accordance with the rules of the New York Mercantile Exchange (“NYMEX”), Buyer shall sell and Seller shall buy a number of futures contracts for the specified Product and month provided in the terms of the Transaction this Agreement equal to the volume to be delivered pursuant to the Transaction this Agreement on a date to be mutually agreed by the Buyer and Seller.

EFP.
