Election Form. (a) Section 2.3(a) of the Merger Agreement is hereby amended by adding the following as the last sentence thereof: “Mercury shall prepare an amended Election Form, which shall be reasonably acceptable to ▇▇▇▇▇, to reflect any amendments to this Agreement that require corresponding changes to the Election Form.”
