Election Not to Exercise Designation Rights. Notwithstanding anything in this Section 9 to the contrary, this Section 9 confers upon Gulfport the right, but not the obligation, to designate the Gulfport Director, and Gulfport may, at its option, elect not to exercise any such right to designate the Gulfport Director.
