Common use of Electronic Recordation Clause in Contracts

Electronic Recordation. Customer acknowledges and agrees that Xxxxxxx Capital may choose, in its sole discretion, to monitor or record Customer's telephone conversations with any Xxxxxxx Capital Representative. Unless otherwise specifically agreed to by Xxxxxxx Capital in writing, Xxxxxxx Capital does not consent to the recording of telephone conversations with any Xxxxxxx Capital Representative by Customer or any third party. Customer acknowledges that Xxxxxxx Capital will not record all telephone conversations and that Xxxxxxx Capital does not guarantee that any recordings of any particular telephone conversation will be retained or are capable of being retrieved.
