Elevated Negotiations. If a Claim cannot be resolved through the Authorized Contractor’s Representative and the Authorized Owner’s Representative pursuant to Section 28.1.1 above, then, upon the request of either party, Contractor and Owner shall appoint senior representatives to meet as soon as conveniently possible, but in no case later than fourteen (14) days after such a request is made, to attempt to resolve such Claim. Prior to any meetings between such representatives, the parties will exchange relevant information that will assist the parties in resolving the Claim All negotiations and discussions pursuant to this Section 28.1 shall be deemed compromise and settlement negotiations, subject to all evidentiary rules under applicable Laws, Regulations and Ordinances.
