Common use of Eligibility and Termination Clause in Contracts

Eligibility and Termination. 1. Upon receipt of an MCSO or QMSO, CareFirst will accept enrollment of a child who is the subject of an MCSO or QMSO. Coverage will be effective as of the date of the order, and the Premium will be adjusted as needed. If the Subscriber does not enroll the child then CareFirst will accept enrollment from the non- Subscriber custodial parent; or, the appropriate child support enforcement agency of any state or the District of Columbia. 2. Enrollment for such a child will not be denied because the child: a) Was born out of wedlock; b) Is not claimed as a dependent on the Subscriber’s federal tax return; c) Does not reside with the Subscriber; or d) Is covered under any Medical Assistance or Medicaid program. 3. Coverage required by an MCSO or QMSO will be effective as of the date of the order.
