Eligible Financial Contracts Sample Clauses

Eligible Financial Contracts. The parties confirm that this Agreement and all Transactions and any related guarantee each and together constitute an "eligible financial contract" under the Bankruptcy and Insolvency Act (Canada), the Companies' Creditors Arrangement Act (Canada) and the Winding-up and Restructuring Act (Canada) and will be similarly treated under and in all proceedings related to bankruptcy or insolvency of a party.
