Eminent Domain and Impositions. To the Knowledge of AH LLC, there are no existing or proposed or contemplated eminent domain proceedings that would affect any of the Properties. There are no delinquent assessments relating to the Properties for public improvements, including, without limitation, those for construction of sewer and water lines and mains, street lights, streets, sidewalks and curbs.

To None of AH LLC, the Venture or any of their respective subsidiaries has been served with any, and to the Knowledge of AH LLC, LLC there are no existing or no, existing, proposed or contemplated eminent domain proceedings that would affect any of the Properties.
