Common use of Encumbrance of Estate Clause in Contracts

Encumbrance of Estate. The University shall not be required to subordinate or subject its fee or leasehold interest in the Premises to the lien of any person or entity providing financing to Tenant in connection with the design or construction of the Improvements or the maintenance and operation thereof. All such financing shall be the sole responsibility of Tenant; provided, however, University shall enter into a Lender Recognition Agreement as provided in Section 14.2 below.
