Common use of Encumbrance of Project Property Clause in Contracts

Encumbrance of Project Property. Unless expressly authorized in writing by FRA, the Grantee agrees to refrain from: 1) Executing any transfer of title, lease, lien, pledge, mortgage, encumbrance, contract, grant anticipation note, alienation, or other obligation that in any way would affect FRA interest in any Project property or equipment; or 2) Obligating itself in any manner to any third party with respect to Project property or equipment. The Grantee agrees to refrain from taking any action or acting in a manner that would adversely affect FRA's interest or impair the Grantee's continuing control over the use of Project property or equipment.
