Common use of Enforceability; Acknowledgments of the Parties Clause in Contracts

Enforceability; Acknowledgments of the Parties. The parties agree and acknowledge that the restrictions contained in this Section 8 are reasonable in scope and duration and are necessary to protect the Company. If the terms of this Section 8 shall be held by a court to be invalid or unenforceable because it is too broad in any respect, this Agreement shall be narrowed by the court to the extent deemed necessary by the court to be enforceable and the same shall in no way affect any other circumstance or the validity or enforceability of any other provisions of this Agreement. It is the intent of the parties that a court enforce these restrictions to the fullest extent permitted by law.
