Common use of Enforcement by Agent Clause in Contracts

Enforcement by Agent. All rights of action under this Agreement and under the Notes and all rights to the Collateral hereunder may be enforced by Agent and any suit or proceeding instituted by Agent in furtherance of such enforcement shall be brought in its name as Agent, without the necessity of joining as plaintiffs or defendants any other Lenders, and the recovery of any judgment shall be for the benefit of Lenders subject to the expenses of Agent.

Enforcement by Agent. In any event, and the recovery of any judgment by Agent shall be for the ratable benefit of Lenders all Lenders, subject to the reimbursement of expenses and costs of Agent.
