Common use of Enforcement of Product Agreements Clause in Contracts

Enforcement of Product Agreements. Seller and Purchaser shall consult and cooperate with each other regarding any breach referred to in Section 6.6(a) and the timing, manner and conduct of any enforcement of Seller and/or any Counterparty’s obligations under the Product Agreements relating thereto. If reasonably requested by Purchaser within twenty (20) Business Days after receipt of notice of such breach pursuant to Section 6.6(a), Seller shall proceed to enforce compliance by the Counterparty with the relevant provisions of the Product Agreements and to exercise such rights and remedies relating to such breach as shall be available to Seller, whether under the Product Agreements or by operation of applicable Law.
