Engineering and Consulting Services. Owner agrees to furnish, at its expense, all necessary engineering and consulting services relating to the design and construction of the Development, including but not limited to, street, alleys, curb, gutter, sidewalks, landscaping, irrigation, fencing, street lights, signage, water, waste water, storm sewer and drainage improvements, trails and park improvements. Said engineering and consulting services shall conform to the standards and criteria for Public Improvements as established and accepted by Firestone. These services shall be performed by or under the supervision of a Registered Professional Engineer and/or Registered Land Surveyor, or other professionals as appropriate, licensed by the State of Colorado, and in accordance with applicable Colorado law. The design services shall include inspection services deemed necessary by Firestone.

Engineering and Consulting Services. (a) Review and Re-Optimizing. WinStar will assess the Network design in terms of its internal five-year business model and the "City Success Model." This assessment may lead to an iterative process to resolve discrepancies and omissions. In addition, Lucent (with WinStar's input, review and potential approval) will continually review and re-optimize the Network design (Architecture and Technology) per a mutually agreed-upon schedule as new users are added, WinStar develops new products, volumes change and technology evolves.

Xxx Xxxxx, Xxxxxxxx 00000 ("City"), and OHM Advisors (“Contractor”) a Michigan Corporation with its address at 00000 Xxxxxxxx Xxxx, Xxxxxxx, XX 00000 agree as follows on this 7th day of August, 2015. If special terms and conditions other than those covered within this solicitation and awarded Agreements are required, they will be attached to the PO and/or an Agreement or Contract and shall take precedence over those in this base TIPS Vendor Agreement.
