Engineering Tests. Tenant shall have obtained and completed all engineering tests, including soil tests, necessary for construction of the Project, the results of which shall be reasonably satisfactory to Tenant. The foregoing conditions shall be satisfied, or waived in writing by Tenant in its sole discretion, on or before December 31, 1997, or either party may, upon ten (10) days prior written notice to the other, elect to terminate this Lease. Upon such termination, neither party shall have any further rights or obligations to the other. If Landlord elects to terminate this Lease as provided in the preceding paragraph then, within such ten (10) day notice period, Tenant may waive in writing any conditions remaining unsatisfied, in which event this Lease shall remain if full force and effect.
