Entire Agreement; Written Modifications. This Agreement, the Non-Compete Agreements, and the specific documents referred to and incorporated herein by reference (whether or not copies thereof are attached to this Agreement) together contain the entire agreement between the parties and supersedes all prior or contemporaneous representations, promises, understandings and agreements between Executive and the Company.
Entire Agreement; Written Modifications. This Agreement, together with Appendix A, Appendix B, and Appendix C, contains the entire agreement between the Parties and supersedes all prior or contemporaneous representations, promises, understandings, and agreements between Executive and the Company.

This Agreement, together with the attachments hereto, contains the entire agreement between the Parties with respect to the subject matter hereof, supersedes all prior written or oral communications, agreements or understanding that may have existed prior to the execution of this Agreement, and may be amended or modified only by a written instrument signed by or on behalf of all Parties or their respective successors-in-interest. In the event of any conflict or inconsistency between this Agreement and the Settlement Agreement, the terms and conditions of this Agreement shall govern and control.

This instrument contains the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior arrangements or understandings concerning Employee's employment by the Company; all representations, promises and prior or contemporaneous understandings relating to Employee's employment by the Company are merged into and expressed in this instrument. This Agreement shall not be amended, modified or supplemented without the written agreement of the parties at the time of such amendment, modification or supplement.

This Lease contains the entire understanding between the parties with respect to the subject matter hereof; all representations, promises, and prior or contemporaneous understanding, between the parties with respect to the subject matter hereof are merged into and expressed in this Lease; and any other understandings between the parties with respect to the subject matter hereof are hereby canceled. This Lease shall not be amended, modified or supplemented without the written agreement of the parties at the time of such amendment, modification or supplement.

This Agreement, together with Appendix A, contains the entire agreement between the Parties and supersedes all prior or contemporaneous representations, promises, understandings, and agreements between Executive and the Company, including, without limitation, the Prior Employment Agreement. Notwithstanding the foregoing, this Agreement supplements and does not limit or restrict or alter in any way any confidentiality, non-competition, or non-solicitation obligations that Executive may have undertaken in other agreements with the Company or NDF, including, without limitation, the Prior Employment Agreement, or which apply to Executive under any applicable law.

This instrument (and the Confidentiality Agreement between Xxxxxxx and SSG, to the extent the transactions contemplated by this Agreement are not consummated for any reason) and any and all documents executed by the parties hereto on or as of the date hereof contains the entire agreement among the parties hereto with respect to the subject matter hereof; all representations, promises, and prior or contemporaneous understandings among the parties with respect to the subject matter hereof are merged into and expressed in this instrument and such documents; and any and all prior agreements among the parties with respect to the subject matter hereof (other than the Confidentiality Agreement as described above) are hereby canceled. This Agreement shall not be amended, modified, or supplemented without the written agreement of Xxxxxxx and SSG at the time of such amendment, modification or supplement.
