Entitlement to windfall. Without limiting the rights of a party under this Agreement, unless agreed otherwise in the IPR Management Plan, a party is entitled to retain any payments received from a third party as a result of Legal Proceedings in relation to the Licensed IPR, including from any settlement.
Entitlement to windfall. The IPR Management Plan will set out the process for determining which party is entitled to any payments received from a third party in relation to the third party's infringement of the Licensed IPR (including as a result of a settlement of Legal Proceedings).
