ENVIRONMENTAL AUDIT AND CERTIFICATION. Tenant, upon request, shall certify in writing to Landlord upon termination of this Lease that Tenant is in compliance with this Paragraph. In the event Landlord has reason to believe Tenant has caused environmental contamination, Landlord shall have the right to conduct an environmental audit including a Phase I Environmental Site Assessment (ESA) according to ASTM Standard practice E-1527 by a licensed company at Tenant’s expense and Tenant shall be responsible for remedying any problems identified by such audit prior to the surrender of the Leased Premises and the termination of this Lease. If the audit determines Tenant has caused contamination, at Landlord’s option, Tenant shall be deemed to be holding over in the Leased Premises on a month-to-month basis and Hold-Over Rent shall apply in accordance with this Lease until such time as no recognized environmental conditions are identified in the Phase I ESA report received by Landlord.
