Common use of Environmental Compliance and Mitigation Plan Clause in Contracts

Environmental Compliance and Mitigation Plan. ‌ As part of the PMP, Developer shall establish appropriate controls in its management, design, construction/installation, and documentation procedures to ensure that requirements of the ROD, FSEIS, other Environmental Approvals, and Environmental Laws are met and documented, and coordinated with the East End Crossing environmental commitments. The Environmental Compliance and Mitigation Plan (ECMP) shall be completed and submitted to IFA in accordance with the provisions of Section 1.5.2.5 and Section 7 and shall include the following: 1. Describe how Developer shall achieve full compliance with the East End Crossing commitments, considerations, conditions of Environmental Approvals, Environmental Laws, and IFA review and approval requirements for Design Work and Construction Work. 2. Describe how and where Developer proposes to further avoid and minimize impacts to woodlands, 4(f) resources, parklands, historical properties, Threatened or Endangered Species, wetlands, and waters of the United States. 3. Describe Developer’s process, structure, organization location, and methods proposed for documentation, communication, and QA/QC with respect to environmental compliance. 4. Describe Developer’s plan to take corrective actions to keep the East End Crossing in compliance with Environmental Approvals, Environmental Laws and East End Crossing commitments at all times.
