Environmental ConstraintsThe Engineer shall consider impacts to environmentally sensitive sites (as identified by the Engineer and verified by the State) during the schematic design process. Environmentally sensitive sites include natural, cultural, and the human environment. Examples are historic and archeological resources, burial grounds, neighborhood communities and residential areas, farmland, floodplains, wetlands, endangered species, rare habitats, wildlife corridors, wildlife crossings, parks and nature preserves, geologic features, undeveloped areas, and significant trees.

Environmental ConstraintsThe proposed scheme has the potential to affect a number of international Natura sites. These being the River Spey Special Area of Conservation; Insh Marshes Special Area of Conservation; River Spey – Insh Marshes Special Protection Area and Ramsar site; Cairngorms Massif Special Protection Area; Xxxxxxxxx Forest Special Protection Area, Anagach Wood Special Protection Area; Craigmore Xxxxx Special Protection Area; Kinveachy Forest Special Protection Area, Kinveachy Forest Special Area of Conservation; Cairngorms Special Area of Conservation; Cairngorms Special Protection Area; Loch Vaa Special Protection Area; Slochd Special Area of Conservation and the Moray Firth potential Special Protection Area. The Reporter considers that the Appropriate Assessment in accordance with the Conservation (Nature Habitats, &c.) Regulations 1994 (as amended in Scotland) should be undertaken by Scottish Ministers.

A windshield survey shall be performed from public roadway right-of-way to verify the location of identified environmental constraints to the extent possible.
