Environmental Control Board Liens. In the event that an environmental control board lien filed against Seller is identified as an exception in the Commitment, Seller shall attempt to cure or cause the Title Company to insure over such lien to Purchaser’s reasonable satisfaction on or prior to the Settlement Date; provided, however, that Seller may choose, in Seller’s sole and absolute discretion, to provide an indemnity to the Title Company on or prior to Settlement, in the form of Exhibit G annexed hereto, indemnifying the Title Company against the enforcement and collection of all environmental control board liens filed against Seller in the county in which the Premises are located, so that the Title Company can omit any such environmental control board liens from Purchaser’s title insurance policy. If for any reason Seller is not able to cause the removal of any such environmental control board lien or to cause the Title Company to insure over such lien, Purchaser shall be entitled to exercise its rights under Section 4(b) of this Agreement.
