Environmental Management System. (a) The Operator must prior to the commencement of any Train Services (including any new or varied Train Services) have in place an Environmental Management System. The Environmental Management System prepared by the Operator must:
(i) have regard to the issues raised in the Environmental Investigation and Risk Management Report and contain procedures for implementing the risk management proposals identified in it. The Environmental Investigation and Risk Management Report includes the results of any expert determination referred to in Clause 9.1(f) or any amendment of the Environmental Investigation and Risk Management Report arising from the recommendations of any environmental audit or review conducted pursuant to Clause 9.7;
(ii) address all legislative requirements, including the requirements of the Environmental Authorities held by Aurizon Network from time to time that are relevant to the Operator’s Train Services; and
(iii) identify systems (including audit systems) and procedures to address all relevant environmental risks and ensure compliance with all Environmental Laws.
(b) Prior to the commencement of any Train Services (including any new or varied Train Services), Aurizon Network will ensure that the elements of the Environmental Investigation and Risk Management Report which Aurizon Network is responsible for implementing are incorporated into Aurizon Network’s Environmental Management System.
Environmental Management System. The Borrower shall develop and implement an environmental management system, which will incorporate at least the following elements: a board-approved environmental policy; designated personnel assigned to assess, achieve and maintain material compliance with Environmental Laws; a reporting system to ensure monitoring and oversight by management; and systematic record keeping and management review of budgets and expenses relating to cleanup and compliance with Environmental Laws. The Borrower shall certify the completeness and implementation of such a program on or before one hundred twenty (120) days after the Closing Date. Upon the Administrative Agent's reasonable request, and at Borrower's sole cost and expense, Borrower shall obtain and provide to the Administrative Agent a written evaluation of an environmental consulting firm reasonably acceptable to the Administrative Agent, confirming that the Borrower's environmental management system is reasonable and customary, and could reasonably be expected to identify, remedy and manage material environmental liabilities and/or cleanup obligations.

(ii) address all legislative requirements, including the requirements of the Environmental Authorities held by QR from time to time that are relevant to the Train Services to be operated by the Operator under this Agreement; and
(iii) identify systems (including audit systems) and procedures to address all relevant environmental risks and ensure compliance with all Environmental Laws.
(b) Prior to the commencement of any Train Services (including any new or varied Train Services), QR will ensure that the elements of the Environmental Investigation and Risk Management Report which QR is responsible for implementing are incorporated into QR’s Environmental Management System.
Environmental Management System. The Environmental Management System as described in Schedule 18 (Technical Requirements) is specified in Appendix 7, as attached and forming part of this Schedule, and shall be amended or supplemented by the Contractor as required in accordance with Schedule 18 and in accordance with the procedure set out in Schedule 5 (Design and Plan Certification Process and Review Procedure).
Environmental Management System. The Environmental Management System (EMS) shall be the overarching system by which Developer shall cause Environmental Commitments made during the Environmental Approval and permitting processes, and other environmental requirements to be carried forward and reflected, as appropriate, in the design and implemented throughout the Work. Developer shall utilize the EMS to track on-going issues, identify environmental compliances, non-compliances and identify actions required/taken to correct any such non-compliance. The EMS shall establish a schedule for periodic CEPP review to ensure it is up to date. The EMS shall provide a means to track the reviews and results. At a minimum, the EMS shall require documents in the following list to be on file at the Site and available at any time for TxDOT review:
a) CEPP component parts
b) Weekly Environmental Monitoring Reports
c) Investigative Work Plans, Site Investigation Reports, and remedial action plans as necessary for hazardous material discovery/remediation
d) Wetlands delineations and appropriate Section 404 Permit Application if changes to the design or temporary construction impacts are necessary
e) Port Permit
f) US Coast Guard Permit
g) USACE Permit(s)
h) Mitigation or resource monitoring reports, as required by resource-specific mitigation plans

(EMS) The parties will comply with the Forest Service’s EMS which is a systematic approach to improving environmental performance by identifying activities and environmental impacts that occur on NFS lands. The Forest Service will provide the Partner with details for compliance.
Environmental Management System. DLA Disposition Services implemented Environmental Management System (EMS) IAW ISO 14001:2004(E) and DOD/DLA policy requirements at all appropriate DLA Disposition Services facilities. The EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes and resources for developing, implementing, achieving, reviewing and maintaining the environmental policy of an organization. The DLA Disposition Services EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLA Disposition Services mission. The DLA Disposition Services EMS program is explained in the agency Environmental Management System (EMS) core instruction. Site supplements may detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the DLA Disposition Services tenant and host DOD/DLA facility programs. Contractors and their personnel are required to be aware that each DLA Disposition Services facility has an EMS and to be aware of related policies to perform work and/or gain access to an installation. Each DLA Disposition Services facility maintains EMS awareness posters that identify the DLA Disposition Services Environmental Management Representative (EMR) and host facility EMR for specific guidance concerning an individual facility’s EMS program. Contractors may request current copies of EMS information identified in this paragraph by contacting the local COR.
Environmental Management System. 7.1.1 The Operator shall control all environmental impacts and risks through an Environmental Management System (EMS) and associated Environmental Management Plan (EMP). The Operator shall submit the EMP as part of the Implementation Plan
