Common use of Equal and Ratable Benefit Clause in Contracts

Equal and Ratable Benefit. The Incremental Revolving Loans and Incremental Revolving Commitments established pursuant to this Section 3.16 shall constitute Loans and Commitments under, and shall be entitled to all the benefits afforded by, this Agreement and the other Loan Documents, and shall, without limiting the foregoing, if secured, in any case, shall benefit equally and ratably from security interests created by the Security Documents and the guarantees of the Subsidiary Guarantors. The Loan Parties shall take any actions reasonably required by the Administrative Agent to ensure and/or demonstrate that the Lien and security interests granted by the Security Documents continue to be perfected under the Uniform Commercial Code or otherwise after giving effect to the establishment of any such Class of Incremental Revolving Loans or any such Incremental Revolving Commitments.

The Incremental Revolving Term Loans and Incremental Revolving Term Loan Commitments established pursuant to this Section 3.16 2.4 shall constitute Loans and Commitments under, and shall be entitled to all the benefits afforded by, this Agreement and the other Loan Documents, and shall, without limiting the foregoing, if secured, in any case, shall benefit equally and ratably from security interests created by the Security Documents and the guarantees of the Subsidiary Guarantors. The Loan Parties shall take any actions reasonably required by the Administrative Agent to ensure and/or demonstrate that the Lien and security interests granted by the Security Documents continue to be perfected under the Uniform Commercial Code or otherwise after giving effect to the establishment of any such Class of Incremental Revolving Term Loans or any such Incremental Revolving Term Loan Commitments.

The Incremental Revolving Loans and Incremental Revolving Commitments Commitment Increases established pursuant to this Section 3.16 2.15 shall constitute Loans and Commitments for all purposes under, and shall be entitled to all the rights, benefits and remedies afforded by, by this Agreement and the other Loan Credit Documents, and shall, without limiting the foregoing, if secured, in any case, shall benefit equally and ratably ratably, on a pari passu basis, from all security interests created by the each Security Documents Document and the guarantees of the Subsidiary Guarantors. The Loan Credit Parties shall take any actions reasonably and execute and deliver any Instruments required by the Administrative Agent to evidence and ensure and/or demonstrate that the Lien Liens and security interests granted by the Security Documents extend to and benefit the Incremental Loans and continue to be effective and perfected under the Uniform Commercial Code or otherwise after giving effect to following the establishment of any such Class of Incremental Revolving Loans Loan or any such Incremental Revolving CommitmentsCommitment Increase.

The Loan Parties shall take any actions reasonably required by the Administrative Agent to ensure and/or demonstrate that the Lien and security interests granted by the Security Documents continue to be perfected under the Uniform Commercial Code or otherwise after giving effect to the establishment of any such Class class of Incremental Revolving Loans or any such Incremental Revolving Loan Commitments.
