Common use of Equipment Leases and Financing Agreements Clause in Contracts

Equipment Leases and Financing Agreements. All of the leases and financing agreements to which the Corporation is a party and which relate to the operations of the Schools are described in SCHEDULE 2(G) of the Disclosure Memorandum (the "Financing and Related Agreements"). Copies of the Financing and Related Agreements are attached to such Schedule or have been provided to the Buyer. Except as reflected in such Disclosure Memorandum, there have been no modifications to any of the Financing and Related Agreements; the Corporation is not in default in any material respect with respect to them; and none of the interests of the Corporation in any of them is subject to any restriction except as stated in the applicable document or as provided by applicable law.
