Common use of Equipment Supplier Breach Clause in Contracts

Equipment Supplier Breach. Equipment Supplier shall be in breach of, or in default under, an Equipment Supply Agreement and such breach or default (1) has had, or could reasonably be expected to have, a Material Adverse Effect and (2) shall continue unremedied for the lesser of (x) a period of ten Business Days from the time Borrower obtains knowledge thereof and (y) such period of time under such Equipment Supply Agreement which Borrower has available to it in which to remedy such breach or default.
