EQUITABLE DIVISION OF RECOVERIES BY LICENSEE. In the event that Licensee elects to initiate actions or take steps relating to a conflicting use or act of infringement pursuant to Section 6.3 above, and Licensee is thereby able to recover from a Third Party by settlement or otherwise any damages or other compensation in respect of such conflicting use or act of infringement, such damages and other compensation shall be divided equitably between Licensee and Licensor in a manner commensurate with the division of economic benefits relating to sales of Licensed Products contemplated by this Agreement.
