Equitable Relief Authorized. Executive acknowledges that if he violates any provision contained in the Agreement, the Company’s business interests will be irreparably injured, the full extent of the Company’s damages will be impossible to ascertain, monetary damages will not be an adequate remedy for the Company, and the Company will be entitled to enforce the Agreement to prevent a breach or threatened breach of the Agreement by temporary, preliminary or permanent injunction or other equitable relief without the necessity of proving actual damage and without the necessity of posting bond or security, which Executive expressly waives. Executive also agrees that the Company may, in addition to seeking injunctive relief, seek monetary damages for any breach of the Agreement in addition to equitable relief and that the granting of equitable relief shall not preclude the Company from recovering monetary damages.
