Common use of Equity Securities Portfolio Tracking Error Clause in Contracts

Equity Securities Portfolio Tracking Error. The expected annualized tracking error of the Equity Securities Portfolio as compared to the Equity Benchmark, as measured by the BARRA Risk Model, shall not exceed five percent (5.00%). Unclassified Equity Securities shall be disregarded for purposes of the tests required by this Section 3.04(d).

Equity Securities Portfolio Tracking Error. The expected annualized tracking error of the Equity Securities Portfolio as compared to the Equity Benchmark, as measured by the BARRA Risk Model, shall not exceed five ten percent (5.0010.00%) (it being understood that a breach of this Section 3.04(d) that arises solely from the Fund's investment in Master Fund shares and is included in the Portfolio Excess Adjustment shall not constitute a Trigger Event). Unclassified Equity Securities shall be disregarded for purposes of the tests required by this Section 3.04(d).
