Common use of Establishment of Amount Clause in Contracts

Establishment of Amount. The Gross Settlement Amount is $2,490,000. In no 24 event shall Defendant, absent its further agreement, be obligated to pay more than that amount. No 25 portion of the Gross Settlement Amount will revert to Defendant.
