Common use of Establishment of Depository Trust Clause in Contracts

Establishment of Depository Trust. To effectuate the terms of this Agreement, a Depository Trust (“the Trust”) has been established pursuant to the Second Amended and Restated Depository Trust Agreement dated as of June 1, 2004 (the “Depository Trust Agreement”). The Trust is governed by the Depository Trust Agreement. Whenever the Plan Documents use the term “Settlement Facility” it shall be deemed to mean the Trust unless the reference is to operational activities of the Claims Office, Claims Administrator, or the Finance Committee.
