Establishment of the WhiteWave Executive Severance Pay Plan. Prior to the Distribution Date, the WhiteWave Companies shall take all steps necessary or appropriate to establish for the benefit of WhiteWave Employees who had been eligible to participate in the Xxxx Foods Executive Severance Plan immediately prior to the Distribution Date an executive severance pay plan that is substantially similar to the Xxxx Foods Executive Severance Pay Plan (the “WhiteWave Executive Severance Pay Plan”), to be effective as of the Distribution Date.
